The Supreme Court has said the right thing. The court said that the atmosphere of the country is deteriorating due to hate speech. Such provocative rhetoric needs to be curbed. The remarks were made by Chief Justice of India Justice UU Lalit during the hearing of a petition alleging that hate speeches like massacre of minorities and making India a Hindu nation before the 2024 elections are being given. A bench of Justice Lalit and Justice S Ravindra Bhat agreed with this allegation. Said- The whole atmosphere is getting spoiled due to hate speeches. The petitioner had contended that hate speeches by some political parties have been turned into “profitable business” and the government is not taking any action. The bench said that 58 cases of hate speeches have come before it. Therefore, instead of giving a vague idea to the court, the petitioner should place before the court the concrete position of the same. The Chief Justice said the court needed facts to take cognizance of such cases.

The law has its own demands, so the Chief Justice’s point of view can be agreed upon. But such speeches have become so common and everyday today that gathering facts about them is not a difficult task. The question is, to what extent the judiciary can go in such cases. If there is a perception that this whole project is being run under the protection of power, then it is not easy to imagine what will be the solution. However, in special cases, the judiciary can certainly set an example by giving speedy hearing and giving appropriate punishment. In this context, it is welcome that the Supreme Court has directed the governments of Delhi and Uttarakhand to submit reports on the steps taken in the case of two different controversial religious events. It is alleged that hate speeches were allegedly made at these events.
