Chhattisgarh: Daughter living in live-in against father’s wish is not entitled to maintenance, HC’s big decision

Raipur. The Chhattisgarh High Court has given a big decision in the matter of giving maintenance allowance to the adult daughter living in a live-in relationship against the will of the father.

The High Court has given a decision against giving maintenance to the daughter. The High Court rejected the order of the Raipur Family Court, in which it was ordered to pay Rs 5,000 per month to the daughter living separately from her father.

The 24 year old unmarried daughter is living separately from her family without any reason. The daughter had filed a case in Raipur Family Court to get maintenance from her father.

In this case, the Raipur Family Court had issued an order to pay monthly maintenance of Rs 5,000 to the father. Against this the father filed a petition in the High Court.

The father told in his petition that his daughter was living separately from the family without any reason. Because of the daughter being an adult, they are not even able to stop her.

The father said that he has other children, who are studying. He is a driver by profession and gets a monthly salary of Rs 38,000. Money is spent on family expenses and children’s education.

The High Court, taking into account all the evidence and logic, set aside the order of the Family Court. In the petition, the father told that during the lockdown, the daughter is living without any legal relationship with a young man under seduction.

They want to keep her with them, but the daughter does not want to be with them. The daughter is not suffering from any physical or mental abnormality. He is able to do his own maintenance. Hence she is not entitled to get maintenance.
