The Supreme Court on Thursday refused to interfere with the Governor’s direction to prove majority. After more than three hours of hearing on Wednesday, the Supreme Court had said that the Uddhav Thackeray government will have to prove its majority on Thursday itself. Earlier on Wednesday, Governor Bhagat Singh Koshyari had directed the Uddhav Thackeray government to convene a special session of the assembly on Thursday and prove the majority. This decision of the Governor was challenged by the Shiv Sena in the Supreme Court.
The hearing of this case in the Supreme Court started around 5.15 pm on Wednesday and lasted till 8.30 pm. After hearing for more than three hours, the court delivered the verdict at 9 o’clock. Approving the decision of the Governor, the Supreme Court asked the Uddhav government to prove its majority on Thursday. This decision was already being guessed because the rebel MLAs of Shiv Sena, who were kept in Guwahati for the last eight days, had already left from Guwahati for Goa before the Supreme Court’s decision and preparations for the majority test started in Mumbai. It was done But instead of proving majority, Chief Minister Uddhav Thackeray resigned.
Significantly, out of 55 Shiv Sena MLAs, 40 have turned rebel and they have formed a separate faction under the leadership of Eknath Shinde. They claim that they are the real Shiv Sena. All these MLAs including Eknath Shinde were kept in Guwahati from last Wednesday. From there he has been taken to Goa a week later, from where he will reach Mumbai on Thursday to appear in the floor test. Earlier on Tuesday night, BJP Legislature Party leader Devendra Fadnavis met Governor Bhagat Singh Koshyari and said that Uddhav Thackeray’s government is in a minority and it should prove its majority.
However, during the hearing in the Supreme Court, senior advocate Abhishek Manu Singhvi, appearing for Shiv Sena, said that the Deputy Speaker has issued a notice to disqualify 16 rebel Shiv Sena MLAs, which was stayed by the Supreme Court till July 11. Is. So how can a trust vote be decided now? He said that the Supreme Court should either stay the Governor’s direction to hold the trust vote or let the Deputy Speaker decide the majority.
On the other hand, Neeraj Kishan Kaul, on behalf of Eknath Shinde, said in his arguments that this matter is not about disqualification of MLAs, but to prove majority. He said that notice has also been given to remove the deputy speaker, so how can they decide about the MLAs. He said that the best way to stop horse trading is to get a floor test done.
