Supreme Court’s seal on 10% reservation for poor upper castes

New Delhi. The Supreme Court, in a majority of three votes against two, upheld the validity of the 103rd Constitutional Amendment providing for 10 percent reservation for EWS in admissions and government jobs.

Justice S Ravindra Bhat disagreed with the constitutional amendment regarding EWS reservation and struck it down. Justice Bela M Trivedi, Justice JB Pardiwala also upheld EWS reservation in admissions, government jobs. Justice Bhat, presenting his minority view, said the 50 per cent ceiling on reservation cannot be violated and EWS reservation has to be abolished.

The court upheld the 10 per cent quota for the poor upper castes. The court said that there was no violation of the constitution by this quota. Earlier, the court had reserved the decision after hearing on this issue. (Language)
