Supreme Court’s big decision regarding GST, may have a big impact on your pocket
Today the Supreme Court has given a big decision regarding the compulsion of the recommendations of the GST Council. The Supreme Court has said in its important decision that the Central Government and the State Governments are not bound to accept the recommendations of the GST Council. In such a situation, now the state or central governments will not be bound to accept the rates fixed by the GST Council and the decisions related to the inclusion of the items included in it. In this way, the effect of this decision can be seen on your pocket as well.
A division bench headed by Justice DY Chandrachud observed that India has a cooperative federal system and that is why the recommendations of the GST Council are only meant to inspire. The Supreme Court said that under Article 246A, the Parliament and the Legislatures have equal power to make laws in respect of tax matters.
In India, both the Center and the states have the power to make laws related to GST. The Bench observed that the GST Council should work amicably to work out a workable solution between the Central and State Governments.
