Supreme Court upholds 10% reservation valid

Today, the Supreme Court, while giving an important decision on the EWS quota case being given to the people of the economically weaker sections in the court, has declared this 10 percent reservation valid. A five-member Constitutional Bench of the Supreme Court on Monday upheld the reservation under the EWS quota. After this decision, 10 percent reservation will continue for economically backward people in educational institutions and government jobs. A five-judge bench headed by Chief Justice UU Lalit ruled in favor of the EWS quota with a majority and held that the 103rd Constitutional Amendment is valid. He said that this quota does not violate the basic principles and spirit of the Constitution. Apart from Maheshwari, Justice Bela M Trivedi gave his opinion in favor of EWS quota. Apart from him, Justice JP Pardiwala also justified the 10 percent reservation given to the poor.

Three judges ruled in favor while two in opposition

Let us tell you that during the hearing on this matter, at the time of decision, the five-member bench decided in favor of reservation by 3-2. Those who decided in favor of reservation include Justice Dinesh Maheshwari, Justice Bela M Trivedi and JB Pardiwala. Both these judges termed this quota as illegal and discriminatory.

Reservation started in 2019 after amendment in the constitution

It is worth noting that through the 103rd amendment to the Constitution, a law regarding EWS reservation was passed by the Parliament in 2019. This decision was challenged in the Supreme Court through several petitions, on which the court has given its verdict today after a long hearing. However, during the hearing on this matter, Justice JB Pardiwala made an important remark while hearing the verdict. He said that it also needs to be considered that for how long reservation is necessary? He said that reservation is not the ultimate solution to remove inequalities.
