Compassionate job: High court’s big bench reserved the decision

The High Court had disposed of the petition saying that the petitioner should first submit a representation before the Health Department. During this, the Cardinate Bench of the High Court issued an important order in the year 2019, including the married girl in the definition of ‘family’ under the Dying in Harness Rules, 1974. That is, he was considered entitled to a job on compassionate grounds. However, the petitioner had earlier refused to take the job.

A bench of Justice Sharad Kumar Sharma refused to interfere in the matter and on December 15, 2021, referred the matter to a larger bench, observing that Dying in Harness rules Whether the claim of a compassionate job on compassionate grounds can be accepted after the prescribed period or not? If yes, when will it be considered effective? Will it be effective before or after the order of the High Court? After this, the matter was put up for hearing before a larger bench of three judges of the High Court.
