CISF jawan fell asleep while on duty, dismissed from service, did not get stay from HC

Mumbai The Bombay High Court refused to grant any relief to a constable of the Central Industrial Security Force (CISF) who was dismissed from service after he was found sleeping while on duty at the Mouda Thermal Power Plant in Nagpur. The court noted that he was a member of a disciplined force entrusted with the task of protecting a public establishment. A division bench of Chief Justice Dipankar Datta and Justice Abhay Ahuja on Tuesday dismissed the plea of ​​Kyatle Santosh Ramesh, who was dismissed from the CISF in March 2021 for indiscipline and sleeping on duty.

His senior colleague had found him sleeping while on night duty and earlier also he had been warned for indiscipline and gross negligence of his duty. Ramesh in his petition claimed that the punishment of dismissal from service for the offense alleged to have been committed by him was not justified.

The copy of the order was made available on Wednesday in which the court said, however, the facts which have been proved are quite shocking. The petitioner was a member of a disciplined force entrusted with the responsibility of guarding an institution of public importance and he was found sleeping while on night duty. The court noted that this was not an isolated case of negligence on the part of the petitioner in the course of his duty and earlier also he was found negligent and let off after being warned.
